Switzerland's First Bitcoin ETF: What FINMA Approved

Switzerland has its first Bitcoin ETF for everyday investors. On October 20, 2026, the Swiss Financial Market Supervisory Authority, FINMA, announced it had approved the country's first exchange-traded retail fund that invests directly in Bitcoin. For a financial center that has long been one of Europe's most crypto-friendly jurisdictions, it is a notable step: Swiss retail investors can now get regulated, exchange-traded exposure to spot Bitcoin through a fund structure that sits inside FINMA's supervision.

  • Approval date: October 20, 2026, announced by FINMA
  • Structure: an "other fund for alternative investments" with a specific risk under Swiss law, holding Bitcoin directly
  • Key exemption: FINMA waived the usual risk-diversification rules, citing Bitcoin's long trading history and high trading volume
  • More coming: FINMA says other providers have submitted or announced Bitcoin ETF applications

What Exactly Did FINMA Approve?

The approved product is a retail Bitcoin ETF, meaning its shares trade on an exchange like a listed stock while the fund itself holds actual Bitcoin. FINMA did not name the fund, its issuer or its custodian in the announcement, as Decrypt also noted. Under Swiss law it is classified as an "other fund for alternative investments" with a specific risk.

The interesting regulatory detail is the diversification waiver. Swiss funds normally must spread risk across holdings, which a single-asset Bitcoin fund cannot do. FINMA granted an exemption specifically because Bitcoin has a long trading history and a particularly high trading volume compared with other cryptocurrencies. That reasoning matters for the market: it signals the bar any future single-asset crypto fund in Switzerland would need to clear.

How Is This Different From FINMA's 2021 Crypto Fund?

FINMA's last milestone came in 2021, when it authorized a fund that invested mainly in a basket of cryptocurrencies. Decrypt identifies it as the Crypto Market Index Fund. That product was restricted to qualified investors. The new approval is the first open to retail investors and the first focused on Bitcoin alone, held directly.

What Safeguards Come With a Swiss Bitcoin ETF?

FINMA paired the approval with a clear investor-protection framework. Supervised institutions must mitigate operational and custody risks under guidance FINMA published on January 12, 2026. Decrypt's reading of that guidance is that a Swiss custodian bank generally has to hold the fund's Bitcoin, or delegate to a custodian with equivalent oversight and bankruptcy protection, so the coins stay separate from the custodian's estate if it fails.

At the point of sale, firms must follow Swiss Financial Services Act conduct rules, including clear warnings about volatility and the risk of loss, plus a suitability check. FINMA argues this gives buyers more protection than purchasing crypto directly. It is also explicit that Bitcoin remains highly risky even inside an approved ETF, and that investors should size positions with that in mind.

What It Means for the Crypto ETF Market

Spot Bitcoin ETFs have become a mainstream on-ramp in the US, where products like BlackRock's covered-call BITA fund keep expanding the menu. Switzerland now joins the list of jurisdictions offering regulated spot exposure to retail buyers, and with more applications in the queue, competition among issuers on fees and custody could follow.
